1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Service
WeVibe revolutionizes your travel experience by transforming your text descriptions into visual memories. Describe landscapes, historical sites, or other travel scenes and WeVibe will generate a vivid travel-style image. Some versions may allow photo uploads depending on available features.
The Service may change over time. We may add, modify, or remove features at any time.
3) Accounts
- Provide accurate information and keep it up to date.
- Keep your login credentials secure.
- Notify us if you suspect unauthorized access.
You are responsible for all activity that occurs under your account.
4) Your Content & Permissions
"User Content" means any content you submit to the Service, including text descriptions, photos you upload, and other materials you provide.
You retain ownership of your User Content. You grant WeVibe Team a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and use your User Content solely to operate and provide the Service to you, including generating images based on your requests.
You represent and warrant that you have all rights necessary to submit your User Content and that it does not violate any law or infringe any third-party rights.
5) AI-Generated Content
- Automated output: AI-generated results may be inaccurate, incomplete, or unsuitable for some uses.
- Your responsibility: you are responsible for how you use, share, or rely on AI-generated content.
- No face recognition / no biometrics: the Service does not provide facial recognition and does not use biometric identification.
6) Acceptable Use
You agree not to:
- Use the Service in a way that violates applicable law.
- Create, upload, generate, or share content that is illegal, infringing, harassing, hateful, violent, or exploitative.
- Create, upload, generate, or share sexual content involving minors or that endangers minors.
- Impersonate others or misrepresent your affiliation.
- Attempt to bypass security features or access non-public areas.
- Reverse engineer, decompile, or attempt to derive source code or underlying models except where prohibited by law.
- Interfere with or disrupt the Service, including malware or abusive automated requests.
7) Intellectual Property
The Service (including software, design, and branding) is owned by WeVibe Team and protected by intellectual property laws.
We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, non-commercial use in accordance with these Terms.
8) Fees (If Applicable)
The Service may be offered for free or may include paid features. If paid features are offered, pricing and purchase terms will be disclosed at the time of purchase. Purchases are subject to the applicable app store terms and policies.
9) Termination
You may stop using the Service at any time.
We may suspend or terminate your access if we reasonably believe you violated these Terms, pose a risk to the Service or other users, or as required by law.
10) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR MEET YOUR REQUIREMENTS.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEVIBE TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Governing Law & Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of WeVibe Team's principal place of business, excluding conflict-of-law rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
13) Changes
We may update these Terms from time to time. We will update the Effective Date when changes become effective. Your continued use of the Service after changes means you accept the updated Terms.
